Terms of Use

The following Guidelines are part of the Terms of Use between our Users and MA Lighting International GmbH. For more information please visit https://www.malighting.com.

1. Subject of the contract

MA Lighting International GmbH ("we") provides this web-based service as a user community resource. The forum is for free discussion and exchange of information, experiences and expertise with other users of MA Lighting products. The language in the forum is English. Refrain from posting in any other language. (Except the existing dot2 German forum.)

This service is NOT a replacement for formal channels of technical support. While MA Lighting staff are encouraged to participate in discussions, it may be necessary to direct issues to the technical support team. 2. Membership

Membership has its privileges. Registration and login are required in order to post to the forums. In order to access the Forum, you as a user require a user name and password (together hereinafter referred to as "Access Data"). You can define the access data yourself during registration. You are obliged to take sufficient technical and organizational security precautions to prevent third parties from accessing the Forum using your access data or otherwise. In particular, you must keep your access data safe.

Don't register for more than one User account, don't register for a User account on behalf of an individual other than yourself, don't register for a User account on behalf of any group or entity.

3. Availability of the forum

We make every effort to ensure the possibility of using the forum without interruption. In doing so, we aim for an all-day availability of 95% on an annual average ("uptime"). However, we do not guarantee the uninterrupted use of the Forum. In order to maintain the usability of the forum, to correct errors and to update the deposited information, it is necessary to maintain the forum from time to time. We are therefore entitled to carry out regular maintenance. During the maintenance periods the forum is not or only partially available. We will try to keep the maintenance times as short as possible.

The uptime shall not apply in the event of strike, lockout, force majeure, loss of employees through no fault of our own, unforeseeable default by upstream suppliers, official intervention, unforeseeable acts of third parties not acting on our behalf, technical conditions of the Internet or electricity network that cannot be influenced and similar unforeseeable events for which we are not responsible.

4. Virtual domiciliary rights and prohibited behaviour

We will monitor and moderate the forums to ensure the Terms of Service and Guidelines are maintained ("Virtual domiciliary"). We reserve the right to edit or remove, with or without notification, any post that does not fall within the outlined criteria or which, in our sole discretion, is not appropriate for message postings within these forums.

As a member of this community forum, you are solely responsible for the content you upload or download. But as a community member, we ask that you respect everyone's use of this resource by adhering to the following rules.

Be yourself. Don't impersonate another person or entity, or falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or source of software or other material contained in a post.

Refrain from restricting or inhibiting any other User from using and enjoying this forum.

Avoid publishing, posting, uploading, distributing or disseminating, or offering to do the same (hereinafter "Post") any abusive, harassing, threatening, inappropriate, obscene, pornographic, defamatory, libelous, infringing, vulgar, fraudulent, invasive of privacy or publicity rights, hateful (racially, ethnically or otherwise objectionable) unlawful material or information or otherwise violate the legal rights of others.

Refrain from posting any material that infringes any patent, trademark, copyright, trade secret or other proprietary right of any party (the "Rights"), unless you are the owner of the Rights or have the permission of the owner to post or transmit such material.

Avoid uploading, posting, transmitting, sharing, storing or otherwise making publicly available on the Site any private information of any third party, including, but not limited to, addresses, phone numbers, email addresses, Social Security numbers and credit card numbers.

Absolutely don't upload, post, transmit, share, store or otherwise make available content that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law.

Refrain from advertising or offering products or services. This is not a market place.

Don't post any files that contain viruses, corrupted files, or any other similar software or programs that may damage the operation of another user's computer Please do not conduct or forward surveys, contests, "spam", "junk mail", "pyramid schemes" or "chain letters".

Avoid downloading any file posted by another User that you know, or reasonably should know, that cannot be legally distributed in such manner.

Avoid cross-posting or multi-posting messages. If you feel a message is not in an appropriate forum, please contact a Moderator or the Administrator. Moderators can edit topics, move them to other forums that may be more responsive or relevant or remove topics and threads completely.

Don't harvest or collect email addresses or other contact information of other users from the Service or the Site by electronic or other means for the purposes of sending unsolicited emails or other unsolicited communications. This resource is for supporting the MA community, not a potential marketing target.

In general, be courteous, respectful and helpful. Be open to debate, but don't expect everyone will always agree. Be tolerant, but don't expect everyone will tolerate your peculiar mood or behavior. All Users should feel welcome and safe.

5. Deletion of content and blocking of access

We are entitled to delete access to individual contents at any time, e.g. if there is a suspicion that they violate applicable law or the rights of third parties. We also have the right to block you as a user if you violate these terms of use. You have no claim to the maintenance of individual functionalities of the platform.

6. Final provisions

Should a provision of this contract of use be or become invalid, the validity of the remaining provisions shall not be affected. German law shall apply to the exclusion of the UN Sales Convention.

The exclusive place of jurisdiction for all disputes between the parties is our registered office, provided that you are an entrepreneur, a legal entity under public law or a special fund under public law.
